Tiivistelmä
Following the ‘migrant crisis’ that was experienced in Europe in 2015, the European Union and Member States developed an extensive migration program, encompassing a Migration Partnership Framework (MPF). Member States entered into agreements with third countries as well as within the union itself to actualize the goals of the migration partnership framework. Some of these agreements are non-binding policies that nevertheless shape and affect how binding laws are interpreted and applied. It therefore enhances the probability to dilute the enforceability of obligations, undermine democratic accountability and generally to threaten the rule of law. Questions arise as to the conformity of these policies with international law, especially in the wake of reports of gross human rights violations suffered by migrants due to the application of the policies.
